Don’t talk to the police

This video of an American criminal lawyer, Professor James Duane, has a compelling explanation of why you should never talk to the police if you’re a suspect in a criminal case.

If you can spare the 25 minutes to watch this video, it’s well worth it.

I’m not sure whether the same situations apply in Australia. While we have no constitutional “right to silence”, the Wikipedia page claims that we have established common law precedents for it. Still, I found it very interesting regardless.

Bizarre timing, I came across this via Schneier a few days ago.

Awesome talk, though, and probably still quite relevant for Australians. Did you watch the second part?

In the UK our standard Miranda caution includes “the right to remain silent” while under arrest, however failure to answer questions may count against you if you later rely on the answers in court.
